I installed Tinfoil on the Home Screen(No EmuMMC) and didnt install any pirated software or Backups. My Question is, is the NAND already dirty if i just installed Tinfoil?

Yes, your NAND is dirty. If you have connected to WiFi without any protection like 90DNS you are probably banned. If you had a backup before installing Tinfoil then you can make your NAND clean again (probably) by restoring the backup. And create an EmuMMC.

After you create an emuMMC don't forget to download sigpatches too. Without that NSPs wouldn't work.
Note: Your saves will most probably go back where it was when you got the Backup.

I already knew that but Thanks anyway. I’m just gonna restore my Backup and continue modding. But I got one Question left. I heard that Nintendo reads the SD Card content. Is that true?

I haven't heard such a thing and if they did, I would probably be already banned
