Right. They choose to go offline after threatening legal action. Nintendo was in the process of developing a legal precedent (which is a very costly and time-consuming process, by the way. Especially when considering international law).
If Nintendo could just go knocking off everyone's server, they would have dismantled TX long ago. Hell, Microsoft would have.

yeah but that’s the point - N patched the console, so they’ve limited the number of potential consoles that can use ROMs - without modchip (mine works fine, thanks).

My (tongue in cheek) point was that it makes more sense for N to go after the source of modchips (presently 1 - TX) than try to unpublish ROM files that are in the wild already and can’t be taken back.

I feel like people forget DDoSing is a thing, Cloudflare and other mitigations aren't impossible to bypass and people would do it to TX just to make people do things like this. But also hosting companies have maintenance and so do website owners do their own maintenance themselves there are multiple things to take into account that aren't just Nintendo.
