How to tell if the games on a hdd or internal memory are bought and installed the legal way?

Well if you don't own the games and you have them now that's 'not the legal way". Say I have a fire red pokemon cartridge then I dump the rom to a drive. If I give someone else said game/drive (all copies) the other drive/cartridge needs to go with it. If it's a pc game those are generally linked to your accounts so you would know if you own said games legally.

Ok. So otherwise the not legit games works the same as original? For example play online or buy dc?

Yeah, they work the exact same as original for the most part, not even needing CFW to work. The exceptions are DLC and eShop exclusive titles which do need CFW. But you can use purchased DLC on a pirated game just fine and vice versa.
