I just bought 3 carts within a short period of time and about 20 carts since my collection. Nothing has happened to me, I haven't faced any legal issues, etc. Most sites ship them with the
description of "Game" or "accessory." on the package.

It's not an issue of legality. 1 year ago, I asked mom to buy a game from another country. It never came, so, from now on, all purchases must be from America. (Even though there just as many people here likely to rip you off as in the rest of the world. *sigh*)

The tragic irony here is is that 3ds-flashcart has a hit n' miss reputation. There have been a few users who've reported not getting their item or getting the wrong item. Which is ironic because the China based nds-card has never ripped anyone off.
Try looking on eBay. They try to ban them, but if you search for things like "ds sd adapter" you're likely to find them. I got mine from eBay. Take a look at these:
EDIT: I checked, they're all from the USA
Please don't buy flashcarts off ebay. eBay doesn't allow them and often times these accounts are ripping people off by exploiting that knowledge of eBay's rules. Coupled with the fact that most people who do actually get something, end up with something completely different.

Most sites are shipped from China. I just got mine from Digimartz.com, as it accept PayPal payment, so you can rest assured to buy and needn't worry to be scammed.

I know this post is a bit old, but I'm gonna say the site(3ds-flashcard dot com) is definitely not safe. I just signed up to see what the shipping charges would be and got an email confirming my account. The email included the password I used to sign up meaning they store passwords as plain text. In other words passwords are NOT ENCRYPTED on their site. I can only imagine what that might mean for how they store or use credit card information.

That's the reason why I'm more willing to pay via Paypal from those flashcard sites, most of them without HTTPS and work just like the 3ds-flashcard, maybe you can try the Paypal method too.

As of now, nds-card.com is down, so you can't even use that
NDS-CARD.NET, their new site.

Eidt: Just find 2 sites are supporting Https, R43DSORG, MOD3DSCARD.
