question: if you're system is banned or even if it's sent in for repairs and a new system is returned to you, can you just download your games to the new system? is the content tied to the account, system or both? also, if you have cloud saving enabled, will you be able to download and use saves from the old system on the new one as long as it's the same account?

You don't if you do the 7 wire install for Rebug's SwitchMe. It automatically puts the Switch into RCM, or RCM if you hold Vol + (6 wire install) during boot. No jigs required.
Checkpoint could crash, causing a system log.If you're superbanned, I don't think sys trans works. You'd have to get a hackable switch and do a quick Checkpoint move then clean up.
Nothing to difficult and Checkpoint should be entirely undetectable for a simple transfer and then clean operation there after.

I have two systems. One on 2.0.0, which has my main Nintendo account, with a legit Fast RMX purchase from it. The other is on 3.0.1 or 3.0.2 (I forget).
Now, I really am behind on switch stuff, so I don’t have a full understanding on everything (don’t know the difference between xci vs nsp for example), but really I have been holding off this entire time for emunand, in hopes that it would mitigate ban risks (I don’t care about online, but it doesn’t mean I don’t care about my system being banned either)
My question is, if I unlink my Nintendo account from the 2.0.0 and link it to my 3.0.2 console (yes I know I would have to be on the latest fw do so, but this is hypothetical), would I be able to redownload the game on the 3.0.2 system? I ask only because I am pretty sure I heard early on that game purchases are tied to both account AND console

Also, the thing Nintendo announced a few days back, about having to confirm which system has which ID as you won’t be able to unlink starting September 18, since that’s when 6.0.0 was going to dropped. That’s not an actual server checked date for linking and stuff, it’s just that you won’t be able to do it on 6.0.0 .. right?

Nintendo just made unlinking manually impossible when firmware 6.0 was released; you should still be able to call them and give them a legitimate reason to unlink it such as losing your console, having it stolen, or selling it to a friend. You can also just setup a non-primary account on the Switch that's not listed as the primary account so it can have access to all of the same things as the primary Switch as long as the second console is online.
