Seriously, I'm getting a bit confused and what is the meaning of "open-sourced" code?
Think of writing a scientific research article by presenting evidence rounded up by other people but not providing credit where credit is due and instead claiming it as your own. You are allowed to use their evidence but you have to ask for permission and thank them afterwards

IDK, the fact you dismissed it because "the cfw is free". You still have to provide attribution and make the source available.

It means the source code is available. But there different licenses with different rules.

This is what you replied to: "Cool and awesome. I'd be fine if they were stealing code if the product was free, but it isn't."

So my point still stands? (It's still stealing code even if that part is free.)

As a general rule of thumb, if someone else made it, give them credit. Unless they've explicitly said it's okay, through type of license or written permission, not giving credit is a dick move and usually violates various laws depending on what countries are involved (copyright usually). If you're going to sell something that someone else created, and do so without permission, then you get into illegal territory.

It's not illegal to create homebrew (in most countries), but it is illegal to steal someone else's code and sell it. The selling it part is what escalates this from "being a dick" to "illegal". Same as if you tried to sell roms. No matter how iffy the personal usage of roms may be where you are, it's pretty obvious selling them makes it way worse. Same kind of thing applies here, if true. I can't speak to the validity of the claim, but I can comment on what kind of laws/rules are being discussed.

CC0 (no copyright reserved) is the type of license that lets you do whatever you want with the materials with no credit. This is most definitely not the license involved here.

As for the brick code, I was wrong. Not only it is more destructive than I originally thought (it tries to corrupt boot partitions too), but it's also deployed on *multiple* stages across the boot chain. It is also way more likely to be triggered on accident than expected.

Also checking his Twitter account, legal action is (not surprisingly) most likely not going to be pursued as they "don't care enough for that".

Yes you can, granted you obey what is stated in the license, and including the license. If you do that, you can do whatever the hell you want with the code.

Obviously TX didn't do that, but is anyone really surprised by it?
It's just a storm in a tiny bottle, nothing is going to come out of this, I don't see why people are even making a fuss about it.

I do have the cfw. Somebody on the temp did a giveaway of a sx os key and I won. It works good but I don't like how it can brick switches and it steals code from other people...

I mean to be honest I somewhat do give a shit because as a programmer it is shitty to know that your code was stolen. But do I care ?....Not really.... If it works, it works.

The CFW is free, the backup loader is not. AFAIK the stolen code isn't in the backup loader. :x

And even if that were the case, per the terms and conditions of the GPL, if you use a library as part of a larger program, you have to distribute the source code under the GPL as well.

1. Hacking a Hardware System you own is legal in most countries.

2. DevMenu was not hacked. It was released, yes.

3. Functions such as piracy were only allowed by TX, and some people who came up with the whole LayeredFS swapping. I don't think these people are the ones complaining.

4. Yes. Because it's immoral.

Everything you mentioned isn't sold. Nobody in the switch homebrew scene wants to, and will make a ton of money with their hacking. TX have made at least $100k with software that was mainly written by others. It's immoral.

lol it aint you need to look up the laws cause thats for phones not video game consoles sony won the lawsuit against geohot

devmenu being is illegal full stop and all yall were happy about that i seen it all over here and reddit lol also tutorials how to use it too
 
I think i'm missing something but is it possible that 2 different companies might both work separately and come to the same answer and not even know it. I'm not saying they did or they didnt but theres a chance that 2 separate people could invent the wheel at about the same time. especially when it comes to code seeing as most of the the best solutions will more or less look and or be the same. Isnt it hard to check an entire program and make sure there are no similarities between them. Could just be a random occurence, most likely not but i figure someone should throw this into the ring to see people tear it up.

Sony didn't win, they settled. Also it might surprise you, but the world is bigger than just the US.

devmenu isn't illegal. Saying that something is illegal, allthough even you will have to admit, that devs can use it fully legally, is kinda dumb, isn't it? Nevertheless, the person who signed the NDA, and sold his dev Switch did something illegal, yes. No one except this dev has done something illegal regarding devmenu though. Same as reading WikiLeaks or some shit. The person who leaked it did something illegal. You, the reader have no obligations regarding it whatever.
