Hacking Question Can I use my account?

Personally I'd rather not link a clean Switch to a previously flagged account, or even use the same payment info on a new account.
 
The way Switches online services work means they check both your console and your account so they know what and who went online. Now, we can only speculate why the choose to only ban the console and not both. Probably because they're trying to squeeze some money out of you to still use the eShop or they feel a bit guilty of removing access to your purchases, or both. But if the same account does something ban-worthy on another Switch, they might decide to ban both. So it will work initially, but unless you're going cold turkey, don't expect it to last long.

Then reasonably they have no reason to ban the second Switch/account. You just have to hope Nintendo will allow you to un-link the account in the first place. Before that, it might be worth checking if the eShop still works with your Nintendo Account using a computer.
 
what are the odds of buying a new switch or new games and having them be banned? I haven't updated past 4.1.0 which is what my system came with, but I'm a little hesitant that something like that could happen. I know that it's probably unlikely but maybe not impossible assuming the new games and console were returns. I assume that stuff is sent back to Nintendo?
 
If Nintendo ban your account may as well go all out rogue SX OS guns blazing backup galore that's what I'd do.
If you want to play online in the future time to make a new account for that new switch.
 
If you go clean, Nintendo has no reason to then punish your account again.

The more users they deter from this with bans (which seems to be a fair few here and in other places) is effectively a net positive for them in an otherwise lost 'case' for the unit.
