I made this scrappy diagram in Paint:

as you can see, the compiled game does contain code which may not be freely distributed, if it's made using Unity
Here is the problem though: Unless it is open source, nobody can access the SDK which he used to make the program.
 
I improved the image a bit, the problem is the copyrighted runtime which is packed with the cias
EDIT: my wording was in the original version not very good, the SDK is Unity as a whole

That's right, Unity 3DS is made for both Old3DS and New3DS, but they highly recommend targetting the newer hardware for obvious reasons. :-)
 
Still, never release a Game made with Unity for 3DS as Homebrew.
Unity for 3DS uses the official Nintendo CTR SDK.
It's highly prohibited and breaks the NDA.
Nintendo could punish you for that.

There's only one way to release it legally: The Nintendo eShop.

"pray" is good.
Would be too dangerous in my opinion.
I'm working on a game Unity for 3DS, too.... but I would never release it as Homebrew because of the NDA.
I'm allowed to make Youtube Videos about the progress, tho.
