Hacking Transferring 3DS accounts

Okay, so I have Luma3DS in a New 3DS XL and I wanna transfer my NNID to a New 2DS XL. If I delete Luma3DS and I do the transfer, might I be banned? (The New 3DS XL isn't banned). I mean, is it like Luma3DS could leave a trace of something on the New 2DS?

1. You dont have to delete CFW.
2. You can get banned anytime if you ever were online with CFW.
3. NNID (or account or how is it called) transfer does not transfer anything regarding CFW

If you are planning to put CFW on your N2DSXL and go online, yes, you might get eventually banned. If you are just transferring your account and you are not going to do CFW, you should be ok.

I turned off the wi-fi on the n3ds when the banwave happened, I checked and I'm not banned, so that's not a problem, thanks. If I transfer to the n2ds, I'd go without cfw
