Is it? Wiping the nand is definitely an option but that can be fixed with ntrboot, decrypt9, and a full backup or ctrnand transfer. Frying the MCU might still be a possibility though.

Something to detect if you have cfw but rather than doing something immediately, waiting for a while before doing something like erasing your installed games or whatever. But I doubt Ninty is that smart.

Nintendo will be protested like hell if they setup a CFW timebomb, it is okay to prevent someone from doing something to their devices via security holes, and so is banning them from your exclusive services, but modifying another persons property in a unethical way will really get them screwed. They can't ethically modify your device if you don't allow them to, it is that simple.
