Hacking Few Questions (Freeshop, bans)

I have a N3DS with A9LH and Luma installed on it. I have not connected to internet for a while on N3DS and have a few questions before I proceed:

1. Is it still safe to use Freeshop?
2. If I connect to internet, is ban possible?

Thoughts on all of this greatly appreciated :)

If you were flagged before, you can't do anything about it. It's just wait for your ban. But yes, any homebrew is possible to cause ban, apparently what's causing it is invalid title ids/activity log.

That's just a theory.

Is Freeshop still active? Also, I don't play N3DS/3DS games online. I only before connected online for Freeshop, Luma Update, etc... Thoughts appreciated :)
Freeshop 3.x (not an automatic update from TheCruel's 2.x, different main developer) is definitely still updated

If the theory about bans being related to running apps is true (which hasn't been proven, in fact my consoles are 2 data points against) "not playing games online" won't help, but then being banned or not won't matter anyway!

Everything is a theory at this point. Nobody other than Nintendo knows what was going on during the ban wave for sure. A few notes:
  • It doesn't matter which entrypoint you use, people using Menuhax, A9LH, and B9S were all affected.
  • People who had turned off sending data to Nintendo in the spotpass settings, and had turned off sending their currently played game to friends, were less likely to be banned.
  • Nintendo may or may not have a pending ban list. Some of the people who were banned claimed to have not used their 3DS in a very long time, Nintendo might have started putting together a list of consoles to ban months ago.
  • A popular theory is that Nintendo is looking in the activity logs for invalid title ids. You can avoid having invalid title ids in your activity log by uninstalling any homebrew CIAs, and running Cthulu to wipe your activity log.
  • If you use a game exploit, or Luma's new Rosalina menu, you can mask any homebrew you are currently running as a different, legitimate title id.
  • We don't know whether they are banning based on pirated games from FreeShop, it's plausible that they could be cross-checking titles from the activity log against a server-side list of "owned" title ids. Lots of people who were banned had pirated games, but there are also plenty of people playing pirated games who were never banned, and some people who were banned and claim to not have any pirated CIAs installed.
  • They may also be banning people who play CIAs that were ripped from game cartridges that never had a digital release, but we don't know for sure.
  • The banwave appears to be over, but Nintendo could very likely be making a list of 3DS consoles to ban in the future. We have no idea if and when another banwave could happen.
My recommendation is to uninstall any homebrew CIAs and to use a game exploit like Ninjhax, Oothax, or Soundhax for homebrew. Or you can use Rosalina to load the homebrew menu, masked using a legitimate title id.

Now I am scared to enable wireless/internet because of bans...

Side question: When I launch Freeshop, is there a way I can tell if I am using the new/updated one?

If you've been flagged already it makes no difference. Check the ban thread for what you need to disable. Basically you need to disable ALL SpotPass everywhere. Beyond that we're just guessing. Also be aware that any app/game that uses friend service will send bunch of info to Nintendo regardless of your information sharing option.

I believe it's what makes friend list work and by extension the online play in games like Animal Crossing.
Some of the SpotPass settings are turned on by default. Some you set the first time you run the app like Mii Plaza.
