Were you banned, and did you have this option enabled?

But we don't know what the banned people did, some of them could have been using a public LFC, others could have been using Pokemon cheats online.

It's not smart to tell people they are safe when we don't know this is the only mechanism Nintendo uses to identify. We should really try to get a better picture of how the un-banned vs banned systems differ besides this.

For the love of my Floette, no one is saying that this is the only way to get banned.

Oh I was absolutely careless when it came to my system, no doubt. I definitely earned this ban. But I know that I can unban my system in a pinch, since I have two clean LFCS's to spare. Oh, and I have a console that is unbanned on top of those other two.

However, unlike you, I do know statistics. And I know enough to not try to save face when called out for not knowing the difference between a majority and a plurality. But you obviously don't think like that...

LOL you keep doing what you do and see how long the 2 LFCS last you.... But hey you are the bright one who got banned!

I have a US system, B9S/Luma, 11.4, spotpass on. Not banned.

However I also was previously banned for using SuMo too early, and unbanned myself using the local friend code method. It was a private code (from a system transfer).

Could Nintendo think I'm already banned? Has anyone been banned who had previously unbanned themselves like I did?

I have the option enabled and currently playing in the friend list disabled. I just turned off the SpotPass option. I have the the 3DS guide CIAs installed and I'm on AL9H 11.4. I am not banned. I wonder if it has to do with when you hacked the system? Since I only did last month.

i had, and got banned, spot pass was also enabled

The same can be said about those who had the option off. There's no reason why having it on means a higher likelihood of doing something else

The sub populations aren't proportional and perhaps those who have it disabled are more worried about their systems (i.e. giving Nintendo info that could unmask them) since they went out of their way to change a default setting.

Lots of factors at work here...

I have an old3ds with a9lh (haven't got time to update to b9s) luma version 7.0X (don't remember exacly). Shared information is on and SpotPass too. Haven't conected to internet in 2-3 weeks. No visible ban. Can access friend list correctly. I can't make more test since my cousin has my 3ds. In a few days I will try more.
Hope it helps!

EDIT: Probably flagged (?)

I'm coming from the Wii U world so excuse me if this is a dumb question.

Can't 3DS users just block "the usual" domains to be safe?

I block access to these at the router level to avoid this type of thing happening to my Wii U:
c.shop.nintendowifi.net
nus.c.shop.nintendowifi.net
nus.cdn.c.shop.nintendowifi.net
nus.cdn.shop.wii.com
nus.cdn.wup.shop.nintendo.net
nus.wup.shop.nintendo.net

Does that advice not apply to the 3DS? Are they different servers?

Hell no I'm not going to keep doing what I'm doing. I've turned off my spotpass sharing and am going to wait to see what else we learn. Maybe my unbanned console will get banned, and then I'll only have just enough LFCS's to get myself out of this jam.

Also, regarding your offline emunand... you do realize that you have effectively banned yourself from those games, right?

How have I effectively banned myself?

yeah but that would probably stop us from accessing the e-shop and so
