I think what the OP did is acceptable. Many CFW creators linked to their GitHubs where FIRM files were.

The CIA is neither uploaded here or directly linked. I didn't break any rules.

He didn't directly upload them to the Temp or filetrip. Nor are they direct links to the CIA's, thus he did not break any of the Temp rules.
Many CFW creators have links to FIRM's on their githubs, this including ReiNAND, Luma3DS, and SalfFW, to name a few. But they are not direct links to these files, thus they don't violate the TOS.

What actually happens if you install a new one over an old one directly? I'm thinking of installing this on someone else's 3DS, and I don't want him to lose all the stuff he installs if you release an update.

you can reinstall the vanilla HOME Menu over the modified one before you update.

Készíts biztonsági mentést a sys/emuNandodról (ahova telepíteni fogod). Ha ezt a lépést akármilyen oknál fogva nem tudod megcsinálni, ne kezdj bele a patchelésbe, mert így nem fogod tudni feltelepíteni a javított, elírásmentes verziókat!
Töltsd le a CIA-fájlt.
Másold át a 3DS-edre. (Én az ftBrony-t ajánlom)
A sysNandodból CIA Encrypteld a Decrypt9-nal.
Telepítsd FBI-al.
Indítsd újra a gépet.
Halj bele az unalomba, amíg bootol a rendszer.
Tádá! Magyar HOME Menu!

Hello, Hungarian people! I'm finally ready with my Hungarian HOME Menu Translation. (I was working on it the whole afternoon) This contains the full translation of the entire HOME Menu. (For screenshots, see the "Screenshots" spoiler in the Hungarian section.)

Spoiler: Tutoriel

Create a backup of sys/emuNand (the one you're going to install it to). If you cannot do this step, stop doing the tutorial now, because without a backup, you cannot install the later patches!!
Download the CIA file.
Copy it to your 3DS. (I recommend ftBrony.)
CIA Encrypt it with Decrypt9 from your sysNand.
Install it with FBI.
Restart the console.
Die of boredom while the thing boots.
Tada! Hungarian HOME Menu!

IMPORTANT: Do not update by installing the new CIA on top of the old one! Restore your backup (when you had the original HOME Menu) and then install the new one!

2. That means all ROM Hacks area illegal (if we use your logic)
