I recommend the "Windows iso downloader" you can download it everywhere since it's legal.

Edit: or the official Windows media creator from the ms website

It downloads the ISO from windows then helps you either burn the image or make a bootable USB drive... be prepared to pay for windows

windows 10 is free if you have a windows 7 or higher installation

Yes, but only by using that link.
Microsoft stopped giving it out for free a long time ago, but they still allow you to get it for free through the accessibility option.
It's the same thing as normal Windows 10, so no worries.

I wouldnt mind upgrading to Win7 then to win 10 too see if it helps

How do i do that

Windows 8 isn't free.
Windows 10 is.
Just upgrade using this, I did on my tablet, then reset your system if you want it to be like new.

i suggest you to just download the iso, put into a thumb drive and install it from scratch
that computer is slow as fuck, to upgrade twice you will just waste a really high ammount of time
we are not talking about just running an exe and go.. this can take you 2 days if you follow the "upgrade twice" path (that computer is really slow) and it's not that worth

download the iso from microsoft website
https://www.microsoft.com/en-us/software-download/windows10
you have to use a thumb drive of 8GB IIRC (cleaned)
boot the pen drive from bios, and then install it...

you can use windows 10 without a license, the only bad thing is you can't change your wallpaper and you get a grey message on the bottom right (doesn't botter at all)
or you know, use some "unnoficial activator"

keep in mind, backup all data on that computer before doing this, because it will be clean

I would recommend something like Linux Mint over sticking with XP, outside of legacy reasons, since it's no longer being updated.

Oh op is on Windows XP?
That PC might be a bit too slow then.
I really reccomend going with Linux. As @tech3475 reccomended, Linux Mint is great but there are also other good distros for begginers out there.

Linux is way more lightweight than Windows and doesn't have MS spying on you.

So i recently picked up a mini pre-owned laptop due to its portability.

However, they laptop itself is on some form of Windows 7 and i want to upgrade the Operating System to Windows 8 since as far as i am aware that operating system is free whereas Windows 10 isnt.

The laptop which i purchased second hand is the Asuse Eee 1000:

https://www.asus.com/us/Laptops/Eee_PC_1000H/

I already own a HP intel Pentium that is on Windows 10 but i really need another laptop that is smaller on windows 8.

So can anyone help me on installing WIN8 on my mini laptop?

Update:

The actual operating system on the mini laptop is :Genuine Windows® XP Home

Why don't you google it ? It gave you a lot of answered. Thats how I learned to do that like you a long long time ago thanks to Google. It is much faster than here. :)

Windows 8 is not free. Windows 10 technically is using the accessibility loophole, but only if you have a valid Windows 7 or 8 license. And I mean valid, Daz loader and key servers do not work. You cna try getting a dirt cheap OEM license for Windows 7, but honestly I'd just get a new computer. Try Linux Mint.

My laptop now actually feels more like a laptop then a slow as hell craptop.

Just wanted to give you a proper update since i diddnt reply back before.

Daz works for Windows 7, but that install cannot be upgraded to Windows 10 for free, as Microsoft checks.
