How can doing that bite him in the ass? The worst thing that could happen to him is Nintendo returning the console just like as it was. Period.

Just for the hell of it I would try data recovery just see. 32GB is large enough that the data could still be intact.
My go to file recovery is Active@ File recovery. http://www.file-recovery.com/download.htm
it's a paid program but the demo will allow you to scan for the file at least.
If you are savvy enough I'm sure you could find a full copy somewhere.

You figured it out.
Now as vb said yesterday recovering the files could be corrupt.
I just tried it on my 128GB and they where corrupt.
I'm going to try on my 32GB card. brb.

OK, so I just tested my 32GB Kingston SD card.
I wrote 4 NAND images to the card. Made a md5 hash for reference, deleted the files then recovered them.
3 of 4 where OK 1 was bad.
It's is possible the recovery will be good or bad on a 32GB card 75% success rate in my case with 1 test.
You will need a hard mod to try to recovery.
Now it might be possible that the NAND you recover might bad but might allow a system to boot and enter recovery afterwords on a higher firmware.
If this does work you would be on 11.3 but that's better then nothing.
Do note if a NAND recovery is attempted make sure who ever does the recovery makes a backup of the NAND in the current state just in case.

Also you you would need to "buy" that program to do the recovery.
