It was leaked and installable for retail units. It's perfectly fine to be ran on retail as well.dev menu is meant to be used on a dev unit (as the dev unit is built alot different than the actual 3ds youll probably have to do alot to get it working)

No, because it isn't a legit CIA. The only way to get a legit CIA is have it preinstalled on the console. So like the MK8 bundle 3DS can make a legit MK8 CIA. The Pokemon bundles can make legit Pokemon CIAs and so forth.
