Hardware What to do?

I bought a white new 3ds 3 months ago as a Christmas gift for my cousin from eb games, he opened it last night and realized that the hinge is super loose and wobbles like crazy compared to mine. What should i do now? will EBgames/gamestop accept a exchange for a new console 3 months after if it was meant as a gift and wasnt opened all that time?

I don't quite think there's a fix for it, O3DS was like this too. Just get another N3DS. Fortunately, my N3DS Super Mario 3D Land had a super tight hinge.
