europe and australia eshop are different as well tho both consoles are considered EU or PAL region..

If your in the USA then yes your fine. But if you still feel nervous, You can back up the save and reinstall an eshop version
However if you are in Europe or purchased your 3ds there, then it is not safe

You know what? My country also selling it before release date (Start selling 18th, which still 17 in US time zone).
A lot people in my country knows the news about early players got ban, they decide to not playing it.

Again, If what you said is true, collect evidence such as paying bills or purchased history and contact Nintendo.

Also, did you went offline between 18th to 23rd? Nintendo ban news can be found in a lot of place include Facebook and Twitter.

And everywhere else on the 19th.

Personnaly I'm not banned and I play on the 19th online.
