They just need to check purchase history. You have none and it is not one of those pre-install sets. Why is this so hard to understand?
also do you know how much work they would have to do to see everyone history if they did. that would take to much work to ban ppl.

Because you could have a cartridge? Like many other people who were banned also had. You're not going to have purchase history with a cartridge dude which is what CIA's essentially are, just installations on the home menu. They do not work the same as eShop installs. Stop thinking they do.

How are even the ban being given out?
Some users say it's on waves.

Other seems to imply it's after some time you played.

Another one mentioned it was 'retroactive' and that we will all be banned eventually.

Anyone knows how the bans are truly being given?

Nobody knows.

This. Are there people who weren't banned before and are now banned? Or was it all at the same moment?

no headers means you cannot be using a cart, and the leaked version definitely has no headers since the dumper removed them

now I understand why so many pple are getting banned now... gg o.o

There could be something that checks the list of installed titles on your system.
If it detects Pokemon Sun or Pokemon Moon on the system, you get banned.

They could have something set up that checks the installed games on your system (excluding any game cart you have inserted) and then checks your Nintendo e-shop account, and if there is a mis-match, the ban is issued.

It has nothing to do with not going online in-game, it may be involved with just having the game installed and then having your 3DS connect to the internet, period.

I never accessed any online feature. I do have over 80 hours of gameplay on my save for Pokemon Moon. Who knows what caused it? Who cares at this point. I never played games online that much anyway. If I want to play Sun and Moon online so darn badly, I'd look into removing the ban using my currently un-banned old 3DS.

I'm puzzled over this as much as everyone else is, there have been a number of users on this thread that have stated that they never connected online.
To the users affected that never connected online: Do you have a NNID? What was your Friend Settings for the 3DS Set to? Did your system connect to the internet on the home menu at any time while you had Pokemon Sun or Pokemon Moon installed?

Whoever goes online is instant banned everyone got warned and been told before and now

We can assume, based on my case here, that "going online" extends to having Wi-Fi enabled on your 3DS while having Pokemon Sun or Pokemon Moon installed (not the pre-load, the CIA rip of the cart leaks)

@Majickhat55
Then I do not understand how I became banned.
I used the same CIAs that everyone else used. I never connected to any of Pokemon Sun or Pokemon Moon's online features. It's been confirmed countless times that accessing the Friend Plaza doesn't connect to the internet, but instead does local wireless.

Nintendo's vague quote stated that any system that connected to Nintendo's servers that had the software installed flagged their systems for the ban. When your 3DS first connects to the internet, much like the WiiU, it checks your 3DS's firmware to see if it's the latest one. Nintendo could have put in a check to see if you have an unlocked Pokemon Sun or Pokemon Moon game. They could have had it check your play history app. Who knows what they did. Safest bet is to avoid having your 3DS connected to Wi-Fi until the 18th. Delete Pokemon Sun and Pokemon Moon and re-download it when the so called "version: 0" fix dump is out. Delete your save data.

The best thing you could do; if you have a NAND Backup before you installed Sun and Moon, delete the games and their ticket, then perform the NAND Backup, then just re-download the PROPER dumps of the games when they come out.

Considering you are the ONLY one to report this (lots of pirates are claiming they were not banned, while you are the only case I have heard of being banned despite having not gone online), we can ACTUALLY assume you are mistaken and went online, or are lying.

Ive been playing with the wifi ON since the first leak appeared. AHL9+Luma 11.2.0.35U. Still not banned.

I have not used any online functions within the game though if that matters.

I was have been playing other games online with the leaked cia's installed both before and after the ban wave. Been playing MK7 online today, cia's still installed. No ban. My theory on the people that didn't go online, but got banned, is it MIGHT either be the eShop, or having the WiFi on while in sleep mode, or having the option to show friends what game you are playing turned on in the friends list settings. I didn't use / do any of those 3 things. My reasoning is that the version is edited to be version 0, and some people have reported an update showing up for the games. I think being in sleep mode with WiFi on, possibly even highlighting the title for too long with WiFi on, or entering the eShop with the title installed might be what did it, when it checked for updates for an unreleased title. Again though, just a theory.

Yeah, this is what I've been trying to find out. There are so many questions that trying to figure out the anomaly of why certain people weren't banned. The biggest one for me being the conditions that caused someone to be banned in the first place.

If we presume they only banned everyone who connected to the Plaza and used internet features, why are some of those still safe?

All in all I think there are too many questions to draw any definite conclusions whatsoever.

It was already proven people get auto banned if they trade online or battle or wonder trade even if you do own the original cartridge early

Do we know if anyone got the 2812 error if they owned the game legit? If so, then that error has a higher likelihood of being temp or lifted

Just heard about this lads. RIP.
