Can anyone confirm if this is related to going online with a console header rather than cart header, or just related to the nature of the dumped game being detected as pirated? woud like some info on that because I have the leaked version installed but never launched it (waiting for release day to play it). So are bans likely if going online with the leaked cia even after the 18th be dangerous?

So this has nothing to do with having a gateway to begin with as many gateway users are just using CIAs as well. Ironically I only use .3DS for offline titles since CIA were supposed to be "safe".
I think its because Nintendo can tell if your playing the game via cart or digitally. Since many people alread have the game cart of Sun and Moon, they dont get banned for going online. Because Gatewait/Sky3ds emulates the game cart, they are also lumped with the legit players, thus not getting a ban.

Thing is that the .3ds version was built using the .cia version so should be Version .0 instead of Version.32 or whatever it should be. So i dont think its the file extention itself that matters.

It has nothing to with the header it seems but what version of the game you play. If you emulate a cart and play online(GATEWAIT/SKY3DS), you should be fine. If you intalled the cia version as a digital download, then you will get banned for going online.

Removed my NNID, checked the store, can view everything. Tried to make a new NNID, blocked.

It's gotta be a Mac Address ban!

Oook ! For any other french players that are worried : Orange (internet provider) is having a meltdown right know. DNS servers are fucked up and everything. This is why I got a weird error code (not a ban one) when trying to access the eshop.

I know if you go online now with the leaked cia you would be banned, but what if after the game releases? would that still be the case? like say if I go online on saturday with the leaked cia, would the version number be tracked?

I just wish there was some clarity on if it's perm or not.
So that I know if I can start using my 3DS to crack open nuts or something.
Thing is, we dont know intill after 15 days have passed. If the ban is still there after 15 days, then you can start cracking nuts. You can also donate your 3ds to /r/3d Shacks so they can use it to make a shack.

@Traiver
Can you maybe tell us, if it is safe for Europeans to go online with pokemon sun eshop copy (with correct seed) on 18th, allthough the European release date is the 23rd?

It might be or might not be. Best thing to do is backup your save via JKSM and delete the .0version of the games. Then install the right .32versions of Sun and Moon when they are out on th 18th.

This should be no problem, it's like a legit version bought from the eShop, it also could be bought from the AUS eShop since they both sharing the same 3DS region, so I would recommend you to import the AUS seed then.

Has anyone confirmed if dumping your certs from an unbanned 3ds and injecting them into your banned one will fix the problem?

And you dont think, that Nintendo can see, that I have a 3DS with European region and that I am using the eshop version?
With a European 3DS I am normally not able to download the game on the 18th, or am I wrong?

No, you can download it from an european console, just setup your 3DS to AUS to get the australian eShop. But as I said, I'm playing with my japanese copy now and of course online too but I won't be affected by these bans.
