I have a black n3DS XL with menuhax and an 11.0 emunand. I got accepted to the ndp and got unity 3ds. but when i go to build settings i can export for a lot of devices but not New 3DS XL. help~

You should go to the build settings and scroll down. There should be a "new 3ds" build target, but you've got to download a plugin for that. Do you have the latest unity version? Unity 5.4 b24 definately has that.

Are you allowed to talk about that here? Also, whatever you do, don't release it here as it's against the rules. It might fall under the GBATemp warez rule and it definitely breaks the NDA which will get you rekt by Nintendo. My suggestion would be to try and figure it out yourself and keep it quiet if you have it. I think it said on the dev portal that you were to use their forums rather than forums like these.

If you havent yet, make sure you register your 3ds dev license with unity

did you install the new 3ds add on unity thats in the unity install folder you downloaded?

Nintendo is providing a developer assistance, I don't think this forum (and any other public ones) are the best place to ask how to use the official tools.
I don't know other staff member's position on this yet, we should talk about it and we will advise you about such threads.

edit:

Current discussion tend to be like that:
- Sharing here any official or produced game, program, file : Not permitted.
- Talking about the SDK, posting pictures or asking advices how to use tools : you are not sharing illegal files or data, so it's not up to us to prevent you from having any legal issues and we won't close the threads, but remember that by doing so you are breaking your own NDA. You are the one putting yourself in a bad position with Nintendo who entrusted you their tools and services.
- Sharing your project's sources : unknown. We don't know Nintendo's position about it. I suppose it's up to the developers to decide, not Nintendo.
