For CFW, yes, however it requires that you downgrade System Settings (MSET) to 4.x.

If you do not have access to the web browser, you will need a copy of JP Cubic Ninja or OoT, but the Sky3DS flashcart can emulate those too.

You can update to 10.3.0-28J and get homebrew now then wait for the upcoming kernel exploit, but it's difficult to say when that will be other than "soon", so I don't recommend updating for now.

Well, actually i have CN JAP. How is working the downgrade? So basically i have this two choice (downgrade or update and wait eventually). Thanks for reply.

Actually, you don't downgrade: You update to 9.0 or 9.2J, then downgrade system settings to 4.x via gateway menu. You can do this with any games in the list at 3dsdb.com when searching "9.0.0J" if you have that cart. If you have the gateway red+blue cards, you don't have to update at all, but otherwise...

Do you have the web browser? If you don't, you'll have to use this method: https://gbatemp.net/threads/guide-upgrading-8-1-0-0j-to-9-2-0-20j.384960/

If you do, you'll need an o3ds to inject the ninjhax payload save file onto the cart. (Although I don't know if this works on 8.1?)

EDIT: Wait a second. I think if you're able to use your web browser you can browserhax into the homebrew channel and downgrade your MSET with the gateway menu. Do you have access to the web browser or is it making you update first?

Well actually i have an old 3ds with latest firmware (10.3) with ninjhax and i have also a skyblue. On the new 3ds i didn't install nothing at the moment.
I would like to keep the 3ds jap updated, cos i would like to update some jap games and buy also game on the eshop and try eventually (if happens) the new exploit on the old 3ds. I didn't expected to find a firmware so low on this new 3ds. Soo, now i'm just thinking about this options and make a decision.

Are you sure? You can update your games with a cia installer like DevMenu or FBI, and if you wanted to buy a game to support it, you have the option to spoof eShop to gain access in your emulated up-to-date firmware (EmuNAND).

Once you update SysNAND, there's no turning back. However, the latest version will soon be hackable, but anything after that and you'll likely be out of luck for CFW for a long time.

Anyway, if you are still interested in CFW, you can use your SkyBlue to update your SysNAND to 9.0J with a game like Dynamite Johnny (J) in 3DS format, then Ninjhax to downgrade your MSET and get CFW afterward.
