Nintendo usually doesn't ban you unless you said, or did, something. So there's not much you can do. Contact Nintendo's support line and talk to them. They'll probably say the same thing though.

Fuck miiverse, I dont want to be there if they ban people for posting one screen shot. Fishguy6564 posted a screenshot of him changing the title screen to sanic and didnt get banned

My primary public facing Mii is literally a recreation of Adolf Hitler and my screen name is "adolf" and yeah, I'm not banned as far as i know? I'm too scared to go online with my precious low firmware 3DS's.
