Not sure how scalpers keep getting CN and OOT for sale; and whether Nintendo themselves makes profit through those. They basically make it check for updates before you can use it. So they can't really remotely update it, but you can't use it without it phoning home, either (still unknown if DNS blocking works?).
The tubehax DNS does nothing, even when I use recovery mode to delete update data (not sure if that's where it would be remembered? A full backup would be a better test). I applied the tubehax DNS before opening the browser at all so I doubt it is just a cache thing though.(still unknown if DNS blocking works?).

That basically just means the tubehax DNS doesn't block the right thing though, do you know/have one that does?
You can always use OpenDNS and block the new address and the current ones.Well, there's a new url the tubehax DNS isn't blocking yet: cbvc.cdn.nintendo.net. I guess I should've clarified, it's unknown if blocking that URL will let it work.
I set up the tubehax dns and then used the recovery mode trick to remove the pre-downloaded update. Even completely cleared my browser of all settings. Didn't work. Either the browser found out it has an update through an un-blocked link or once it receives the "update" message it will permanently stay that way by storing some data into the nand. :/

Tubehax doesn't block the new URL that the browser calls home to yet.
My 2ds did not come with 9.9, though im unsure what it was out of the box. I also had only used browser hax after smealum said something was up on twitter. I was using themehax until then.Did you update to 9.9 through system update or from a game? (Or maybe it came with it??)
It's also possible that you get a "free pass" if you've used it recently (such as just before this change was rolled out), to avoid overloading the servers - like a cookie that expires after a day or so. That's just speculation though.
