Technically they arn't doing anything illegal...

technically since they're breaking the eula of the 3ds hardware and software agreements, they technically broke the law and seeing how big nintendo are, im guessing they've got some badass team of even more badass lawyers to get gateway destroyed (not the team but carts, brand ect) and all their research data ceased by courts to be destroyed or to be used by nintendo to fix all know security loopholes in their hardware and software. but seeing as i've never known a juggernaut like nintendo to waste money suing people, when they can be making great games to sell on their consoles i think we have no issue with gateway being shut down anytime soon, unless they get a rogue member go double hacker on them and sells them out for a new job lool.

Few days will be their stock answer to anything I assume. They will never say it will be out tomorrow or give a specific date.

EULA does not have any legal standing whatsoever outside of the USA.

Any terms of an EULA which are broken in Europe for example can be overturned in a court of law as it has no legal weight. It's bullshit, basically. More of a terms and conditions than anything else.
