He could reveal the name of the game, before releasing the exploit. Nintendo would then pull the digital version from their shop, thinking it would prevent the exploit from coming to those who don't have the game. Then Smea says it's another game, which Nintendo pulls again, and it goes on forever until Nintendo basically realize they've been played for fools and pulled majority of their games for nothing, and ultimately lost more money than they would have gotten for just simply allowing homebrew.

I know it's a far fetched idea, but it made me grin.
