Hardware 3DS 3D depth screen

Hey guys, got my 3DS today and was extremely upset, it seems to me there is some sort of a problem with the 3D depth slider. When I turn my 3DS on and choose the language, the 3D settings screen pops up and I'm suggested to turn the 3D depth slider to the max and press next. I've done it several times, moved it up from different positions, still the screen with a picture and the message to switch the slider to the upper position pops up. The 3D LED is switched on though. I believe it's the slider that's broken or damaged. Do you think it can be somehow fixed? Or can it be some internal/software issue? I'd sent it back but it's another month or two of waiting plus the delivery costs will be around $50-70, so I suppose it's cheaper to get it fixed.

bought it today? return it today get another new one
I've ordered it from playasia, the postage is at my own expense and as I'm from russia it'll cost me $60-70 so I'd rather get it fixed without sending back and waiting for months till they send me another one.
If you're in Russia, send it into Nintendo Europe.
I would think Nintendo would fix a problem like that for free. I don't know if they pay for postage, though.
But it's the U.S. console, I guess it might be a problem. Nintendo Russia Tech Support conditions state that consoles bought outside russian federation are not subject to 12 months guarantee agreement. I've wrote them though, hope they will somehow help.

Ontopic: Sounds like a mechanical issue to me. Sorry for your disappointment man, I know how you feel. As suggested above. Unscrew the back panel, take out the battery pack and re-insert it after a minute or two. It might do the trick. If that doesn't workout, it might only be possible to fix by opening the 3DS which I don't suggest unless you are really good with the electronics like that.

Meanwhile, contact Play-asia.com as well and tell them everything. Their Facebook support is good as well so politely tell them there and they might find a possible solution, perhaps even store credit to share the loss between you and them.
