Here we go again: Nintendo has won another lawsuit, this time against a seller of MiG Switch devices and circumvention services that allowed for piracy on Nintendo Switch devices. Customers could go to a website called Modded Hardware to purchase pre-modded Switch consoles that came with warez installed. The defendant, Ryan Daly, has been ordered to pay Nintendo $2 million as a result of damages to the company after ignoring multiple cease and desist orders. He was also served with an injunction that forbids him from circumventing copyright protections on Nintendo devices in the future.

Defendant’s conduct has caused NOA significant and irreparable harm. For example, the MIG Devices, Mod Chips, Hacked Consoles, and Circumvention Services allow members of the public to create, distribute, and play pirated Nintendo games on a massive scale. Thus, the MIG devices, Mod Chips, Hacked Consoles, and Circumvention Services harm NOA's goodwill, detract from NOA's consumer base, and enable widespread illegal and difficult to detect copying.

I feel like the title is a little misleading. It seems to me that people selling the MiG Switch don't have much to worry about unless they're preloading it with games.

But I suppose "Nintendo wins another lawsuit against person selling pirated Switch games" doesn't get the same attention. In my opinion, whether it was a MiG Switch, or a preloaded Switch with CFW, or even just a microSD card with copies of Switch ROMs, makes no difference.

As noted, it can happen with both, and it's because of the fact that all of the details regarding physical cartridges are stored server-side. Such details are checked when a console plays physical/digital games online, and if two consoles play a physical game with the exact same details (which is only possible if one of them is a dumped copy ran through a MiG Switch, assuming CFW isn't detected on either hardware first), then that copy is flagged for piracy, and both consoles are banned.

This can make purchasing used copies problematic (or, on rarer occasions, "new" copies that were returned to the store if the store doesn't have a policy that requires the original shrink wrap be intact before accepting a return), because there's no way of knowing if it's a copy that's been dumped to a MiG Switch or similar until you launch the game and get banned. It is possible to have your console unbanned if that's the case, but it does require proving that you legally purchased a used copy of the game, including the details on the cartridge and proof of purchase.

So if you buy your Switch games used, always make sure you have the receipt somewhere you can access it later.

Edited game data to modify its saves can flag it too.

I buy used games all the time. IF Nintendo ever bans my Switch, because someone sold me a game that was dumped and shared, i have the time and the means to take them to court and i'm wiling to bet real money that they will revert my ban or offer me a brand new console just to avoid the bad press (since i do not use any circumvent hard of soft methods on my Switch).

I still find it hilarious that people use the mig in their switch 2 then complain when getting banned, or they keep the switch on low FW in hopes of a mod. people are that dumb and greedy. I could care less if my switch 2 ever gets modded. we got enough games for the other system already, enough is enough

That's the main selling point of it, you put your roms on it, insert it on a console and it just works.

For those who don't care about being banned or not being able to update games on their own, it is arguably more convenient than installing mod chips.

This is always the common denominator among idiots who get sued by Nintendo. It's them pre-installing pirated software.

I have been installing modchips in switch systems for years and get asked almost daily if I will install games on the system after modding it. It's so common that I wonder if any of those requests are from Nintendo ninjas fishing for someone dumb enough to bite.

As long as the system's online shop is going, they'll keep vigilant. And probably after, if the creator is making enough of a splash; there's been cases of Nintendo going after romhacks for ages-old games (one of the more famous ones being the Super Metroid remake someone was doing, along with numerous Pokemon fan games/romhacks). So going after people trying to make pirate-enabling devices on their current consoles is going to be a big one for a while still.

If i have a solid case? What can be more solid than never used any soft or hard mods or anything besides genuine game cards on a never pre-owned Oled Switch? More solid than this only if the console was banned at the assembly line, since i bought it brand new.

And yes the would most likely settle out of court, I'm just saying i will not stand by and take the abuse IF they ever ban me for buying a game card that other person dumped, without my knowledge.
