Is creating a backup needed to ensure future usability?
To my knowledge Nintendo doesn't offer restoring licenses on other consoles. Might be worth asking.
- The Wii console with the license may fail any time. No idea if Nintendo of Europe still services Wii (NOA stopped)
- TVs with analog inputs are a thing of the past. HDMI converters might introduce lag
- The Wii (license) might get lost, stolen, destroyed in fire
- Wii Shop might go completely offline removing redownload options
My non-lawyer conclusion: You may create backups of lawfully obtained software regardless of any copy protection (opposed to video DVD/BD, see UrhG 95a). Illegality definitely is given when sharing (including network multiplayer stuff).
In practice I don't see how big N should have any legal ground sueing somebody using homebrew/CFW for backups. And I mean backups without the quotes, the stupid euphemism ("backups") often used for plain illegal downloads.
