I live in Germany. Neither the Nintendo shop nor Nintendo support can provide me with a battery. Nintendo support only suggests sending in the 3DS, and they would replace it entirely. wich is, of course, the most expensive way of getting a new batteryIf they're out of stock on the official Nintendo shop, then keep checking back; they'll restock eventually.
Otherwise, I've never heard of anything bad happening by using a battery from elsewhere.
