So I’m planning on modding my switch I’d like to be able to customize it like changing the background .I also have legit copies of games if I were to take any on my games online with these customized mods could it result in a ban?
Next question, if I were to pirate games without modding and changing the software could I play those online as well or is that an instaban ?

You need to create an EmuNand (basically a copy of the SysNand of your console but on the sd card) and then run your games from your EmuNand instead of SysNand and you can play on the EmuNand without worries of being banned. The SysNand (The console system) is unaffected since you arent installing anything into the console itself and you can play online on the SysNand like a normal Switch without the games you downloaded on your sd card. Its basically a normal switch and your memory card is another hacked switch. And you can switch between the two using an RCM Jig or RCM Loader.

As long as you dont tamper with the SysNand you should be fine.
