For People Mad About Nintendo's DMCA Takedowns.....

Don't buy Smash or Pokemon Lets Go!

Just boycott Nintendo. I know a lot of people are not in a extreme fit over them Nintendo taking game projects down but, If we were to just NOT BUY there two biggest games of fall/winter then it would have a somewhat medium maybe even large impact on sales if we spread the word around.

idk what else to put but uhhh don't buy smash bros and pokemon

But, my understanding is that if you are the copyright holder of an intellectual property, you are required to make some type of good faith attempt to legally protect your intellectual property if it is being infringed upon or else you risk losing the copyright or trademark for that property.

Almost.
For trademarks there is something called genericide ( https://www.bbc.co.uk/news/business-27026704 ). This is where if you allow use of said trademark to go unchallenged and the public then could be confused over things then in court a judge might strip you of it as you have to uphold it.
It will not happen if it is just some kids on a small forum somewhere doing something ( https://www.eff.org/deeplinks/2013/...-require-companies-tirelessly-censor-internet ), however when your misused trademark makes it onto mainstream trade news sites (and for as abysmal as kotaku, polygon and all that are they still count as that, several of those then reporting on such tools and projects) it makes sense to take action.
Probably also worth noting at this point is the Universal City Studios, Inc. v. Nintendo Co., Ltd. case concerning Donkey Kong -- Nintendo has some experience with the shoe being on the other foot.

Copyright has no such concept baked into it, no real concepts like it within case law and no real push or desire for such a concept as it is designed to protect a different thing and has different attributes (as long as you pay renewal and maintain it you can keep a trademark forever, copyright theoretically expires one day) as well as different standards for infringement.

Eh, I was almost half-correct. I'll take it. Thanks for the succinct clarification there, FAST6191.

Anyway, topic creator, I wish you luck with your boycott. It would seem, from a cursory Google search, that there are somewhere in the neighborhood of 18 million Switches in the wild, and you've got 22 comments on your post, so there's only 17.99 million more people to convince to skip over one of the most anticipated first-party releases of the year, and then we can really stick it to Nintendo for forcing us to have to search out ROMs like it's 1999 again, and having to track down fangame releases and hacking tools on our own
