It depends on what he wants leaked. If he wants screens and videos, what's the problem? Even if he wanted the rom leajed, while it would be illegal, I actually condone it at this point. Gaming has become such a clusterfuck with all the publishers and console manufacturers abusing the DMCA and other laws, setting up tax havens, treating employees like garbage, and many others. I hope it all comes crashing down.
That's why you don't get arrested lol. If I ever received a game early, I know of plenty of avenues I could take to leak it and propagate it to the world that would never get traced back to me. Until the day comes that the game industry has the NSA in their back pocket that is.

True. But if they find out the identity, they will sue the guy who leaked the Pokemon game into Oblivion.
If you want my opinion, if a specific game, movie, book, etc. Is not being actively sold by the owner of the copyright, it should expire after like 20-30 years max. Now, it would be a little more complicated than just making the work public domain. The copyright holder would still hold the rights to the characters and code and shit, and for-profit derivitave works would still be illegal. They could also in the future sell it again in a different format even after the copyright ended (like a VC game for instance) and the copyright would be renewed for that new format (you'd still be free to distribute ROMs ripped from the old cartridges though, and the VC releases woild still be protected for as long as they are being sold + the 20-30 years).
@leon315 He got off easy and all is fine now, so I guess it worked out in the end. But what those people did differently is they didn't make it easy for anyone to figure out their real identity, so they're hard to catch.
