A word of WARNING for those who want to get their 3DS fixed.

Yes, I know this is a blog, but I think it's too important.

On November 18th, I sent my N3DSXL to the Nintendo customer service to get my wobbly circle pad and faulty c-stick fixed. Days kept passing, and today I decided to give them a call to see how everything goes. As they said, they'll fix my c-stick and maybe my wobbly circle pad too, but this isn't what this blog is about. What I want to say is:

SDLESS LUMA A9LH DOESN'T ''HIDE'' YOUR HACKING ACTIVITIES.

Before sending my 3DS, I removed the SD so that the service people couldn't find my stuff and thinking that they would access a clean, pirate free sysNAND. Well, they know, my dudes. They know about SDless Luma. To quote the guy I spoke with: ''Have you installed any software not legally endorsed by Nintendo? Because putting in an SD card, gave me a weird menu(He knows for sure that's Luma's sysNAND).'' For a moment there, I lost my goddamn breath and just said ''No, I haven't done anything like that.'' He just said he would check into it.

I don't want to be a fearmonger, but stay vigilant, people. I am scared as fuck and shaking right now, to say the least.

ROMs may be "technically backups", but the hardware of the flashcart circumvents Nintendo's protection of copyrighted material and hence is illegal. Whether or not they were "backups" doesn't matter. You say that "it's not theirs to take", but Nintendo could most rightly say that it was not theirs to buy either, considering that it's a device that circumvents copyright protection. I have nothing against piracy, but if you're going to talk about "backups", you should at least be familiar with Nintendo's position on the matter. Flash cards, mod chips etc. are illegal (depending on your jurisdiction). See: https://ap.nintendo.com/faq/#circumvention

Long story short: if you've hacked your console, don't send it in to Nintendo, and certainly don't send in a 3DS with a flashcart inserted.

To answer some questions. My C-stick is faulty. It didn't work as expected from day 1. Fact is, I didn't try to open my 3DS to fix it because I thought something might be wrong on the C-stick's board and I can't fix that myself. Secondly, understanding hacking and not knowing how to fix a C-stick are too different things imo. I've always been successful with hacking my 3DS, but I don't really know a lot about it's circuits. Anyways, my 3DS came back unfixed. I'll wait till 11.2 downgrade comes and then I'll wipe A9LH and anything hack related and send it to them again, preferably under somebody else's surname.

You're missing my point. I would never send in a console that's been modified to get it repaired. You automatically lose that right when you mod the system, so it's a good rule of thumb to not modify hardware that you can't fix yourself or don't know any third-party that could do it for you. As for hacking software and messing with hardware, one and the other are and always have been intertwined - just because there are publicly available mods out there doesn't mean that they’re for everyone. If you mod your system, assume that it's not vanilla from this point onwards unless you have a clean firmware to flash it with.

You probably shouldn't send it back to them at all, they may have your console's serial number on some sort of "blacklist." They almost surely won't fix it, and at worst they might just keep it and not send it back next time.

I would never send a modded system for repair, but I think it's safe to say A9LH is going to be detectable by Nintendo regardless of what method you use. Only safe thing to do would be to get rid of A9LH completely, then worry about how you're going to get it back on there after you get it back.
 
@Elysium420 day 1 you mean that you already knew the problem when you purchased and it got worse later? If yes, dont you have the right for a replacement?
 
i just thought, if the tickets for games you install on the sd card are stored in the ticket.db in NAND, then couldn't nintendo check the ticket.db for illegit tickets (not signed)? That could be one way they know you pirated.
 
@naddel81 Yes, I've thought of that as well, but it's not certain whether it will be like that or not. And I'm willing to take the risk anyway when the time comes. I paid extra for that c-stick whereas I could have bought an O3DS.

@RaMon90 I do, but they didn't fix anything because of the hacks.

See that's something I did not know, and you actually bothered to explain WHY it's illegal instead of just saying "It's illegal" like most of the people in this thread. I honestly did not know that it's illegal, especially because where flashcarts are concerned the "intended usage" / excuse is that it's for backups, so I always figured if you got one for backups and had the original games then it would, in fact, be legal.

I still don't agree with them stealing his flashcart though, and I don't see how it's okay for them to do that. If Nintendo can't even legally edit the contents of your SD Card through a system update, how can they format his SD card or keep his flashcart?

Trust me, I agree with you completely. I think that it's wrong for them to take his flashcart, or format or update anyone's SD card or console. I'm not 100% familiar with the legality of being able to format people's SD cards, but if Nintendo are doing it, then I imagine they are legally able to do so.
