Honestly, This is why you have 2 3DS's, One for CFW, one for smooth clean gameplay, If you get banned on the CFW one then is there anything to really worry on? I mean if you're on the CFW one you could probably get unbanned with a bit of NAND editing and so on. My honest thoughts on it tho would have to be Sighax, You know how if you go online with a custom Title ID for a pokemon rom hack (Say Pokemon Rutile Ruby had a custom Title ID, but because it's hooked the ORAS/XY servers, They'd recognize it as a completely seperate game based on the Title ID, thus a ban heading your way) you'll just get banned right? What if that's the same with the 3DS hashes and the eShop? Just a thought :T Could probably be disproven but the best idea I have so far. I also know nintendo could check peoples homemenus, so what if those with custom .cia's installed are getting checked and banned there (explains the A9LH bans)? Honestly I'd just disable my wifi at this point to be safe.

The real question is if anybody with a homebrew only system (no cfw, not even the old menuhax+emunand setup) has been affected.

Did you guys allow sending data to nintendo or no? it automatically turns on when you update. It might send the files for Homebrew/CFW/Bannable stuff to them.

Oh, I made the Homebrew Channel my fav game on my Nintendo profile months ago and was too lazy to change it. I wonder if that's going to come back and bite me in the ass.

Hm. Then have them edit it to say "no known reason"? Being a smart ass only gets so far.
I mean saying no reason is like they are randomly just banning anyone from a random list with no rhyme or reason. For all anyone knows, they could have a list that's been compiled for the past few mos of people using differing things from cfw, to hacked saves, to romhacks, to anything. I don't know why people think this stuff is not detectable. The instant you connect for Internet play they can now probably detect everything illegal done.

It's not illegal, it's just against the TOS.
