Disabled it as soon as i got the console,the console was on sys ver 11.0 .I disabled it before updating and after accepting terms,and it is currently set to "off",not banned(yet).

There has only been 10 votes yet and we only need one honest vote against that theory and we know that it's not that... or at least not that alone.
Not necessarily. If someone was flagged for a ban, and then afterwards turned off information sharing, they might absentmindedly pick that option.
One vote against it wouldn't necessarily hold to disprove it, at least not without feedback from the voter.

One vote against I wouldn't necessarily hold to disprove it, at least not without feedback from the voter.

the spotpass options has two settings, both of which can be enabled or disabled. I had enabled only the send info to nintendo one. Should I vote enabled?

edit: not banned btw.

Alright, seems I might be banned at a later date :D

So, I went to settingt o turn Spotpass off. Turns out I already had it disabled. Which is weird, because I am sure I had it on and I was getting messages from it. So, my Spotpass got disabled at some point without my say so. Weird.

I have two 3DSs. Neither one is banned. Both were recently upgraded from A9LH to B9S and have downloaded games via FreeShop. Neither one was used to play games online for a very long time. One (New) had Spotpass settings turned off for as long as I can remember, the other (Old) had Spotpass settings turned on for as long as I've had it.
