If it is true that 9.7 didn't blocked Sky3DS, what the heck Nintendo do?
They can do it, it's easy. It would take them a week to do that (test false positives and false negatives), but they can do it.
Why don't they do it?
Do they care so less about piracy?

Someone said I don't remember where that if they were to block Sky3DS, they could hurt legit cartridge owners, so they're probably thinking of a smooth way of doing that.

If it's that easy so Nintendo could get the block right now as they have used to do with DS flashcart and given up LOL :))

If the risk for false positives is even 0.1% I'm sure they won't do it. It has to be an absolute detection method, maybe such a thing doesn't exist

Yes, speed checks, like they ALREADY DID IN THE PAST WITH DS GAMES!
Even the almighty DSTWO couldn't manage these protections and needed to patch the games which have those.
Now that they have a preemptive OS and that the games are completly signed, WHY DON'T THEY DO THAT?
I really don't know.

On the Old 3DS, it looks like the update is mostly just to add NFC stuff, for when the Amiibo adapter for Old 3DS comes out. On the New 3DS, it looks like it mainly blocked some DS flashcards, and updated some DS stuff.

Yes, this update basically just prepared for the launch of the NFC adaptater.
But for N3DS, it doesn't block any DS flashcarts : it just adds the DS stuff to the SOAP list.
