You can update to the latest but I think it would update first to the 10.7 firmware and after that to 11.0 (happend to me when I was still on the old 9.0 on my N3DS and at that time the 11.0 firmware was already released).
BTW if you wish, you can also spoof the latest firmware and you would still be able to use Pokebank, use eShop (buy something, update/download etc.) and play online games.
EDIT: Forgot to mention that I have two N3DS consoles (one on latest 11.0 emunand and another on 10.7 which is spoofed to 11.0).... so, I know it from the first hand.

Eventhough the New 3DS XL is more powerful, I still feel like the DS Lite was a more polished system. It's a real shame that it never got an XL variant keeping the GBA slot. You'd have to go on AliExpress and buy an ML shell to give a DS phat the unofficial "DS Lite" treatment, and that's the best we'll ever get I'm afraid.+1 -

@Jayro, I don't see whats so special about the DS ML, its just a DS lite in a phat shell. At least the phat model had louder speakers, whereas the lite has a much better screen.+1
