and how close are we to getting some 3ds roms? b/c at this point i dont really see a USE in hax0ring the 3ds if i cant get any games for it (i am completely uninterested in NDS games. :| )

I don't even know how you came to that conclusion considering there is no homebrew for the 3DS. Either buy some games or go to the fucking Pirate Bay forums and cry there.

well just read it in the legal jargon right above the "accept "button for the 3ds update... if I don't update some software won't work. If I do update any unauthorized software or devices used on the 3ds will (crap forgot the words but..) the same thing as them saying they are gonna brick the system... I know my legal jargon well enough to know what they are saying... which is a loss for you nintendo once this is confirmed I am done with your products...
Can you just see them bricking my 3ds cause they don't want me to play homebrew ds games on it? or read on my 3ds... oh well... guess its off to that horrid buggy android software.... or windows mobile... sigh

You're like 9 months late on this. Same crap they've said since day one. I just updated with my ds2 in the whole time, absolutely nothing happened. Just like nothing has happened on the previous 5 updates. Nothing ever will happen. The end.

.....For fucks sake, let a 3DS get bricked and then start back up this topic. Ninty is not saying they will brick your system. They are saying that they can not guarantee the use of your system when using programs/games that they have not made.

You have pretty crappy legal jargon. The user agreement is more or less and escape clause for Ninty to not have to bear the replacement or repair of system that did not naturally break, or break/brick from normal user use. There's a reason once your warranty runs our or is used that it cost so much to get it fixed.

Nintendo might be able to get away with bricking legally due to the wording in their EULA. Thing is, they won't because there is still a chance they could lose a large court battle and I don't think they like to take that risk. That's not including the probable public outcry of enraged parents wondering why Nintendo broke their little pirate kid's console (they would have plausible deniability that they didn't know what their kids were doing).

I was thinking the other day that there are still many AP tricks that Nintendo could try and possibly get away with. One would be to include a 1 minute penalty timer every time a game is started. That could possibly be an effective deterrent to piracy and spare Nintendo from the legal risk of breaking innocent people's systems. Of course, I don't think Nintendo would go that far until 3D mode is hacked and their cash cows are compromised. :P

Personal agreements aren't above the law.

Hell, Nintendo's EULA and shit SAYS that if any part of it is found to be illegal, then Nintendo can replace only that part and the rest if it is still in effect.

Like I've said in the other non sticky version of this topic, you can OPT OUT of submitting your Activity Log to Nintendo, just go to system settings. If you opt out of submitting your play records to them how are they going to know? =P

You'd think all the paranoid people would've learned their lesson about these "forced bricks" after 5 years of them threatening the same on the Wii and never doing it.

The very worst they can do is release new voluntary updates that block flashcarts - which is, unsurprisingly, the only antipiracy measure they've taken for the last year... and the only antipiracy measure they ever took on the Wii... I'm sensing a pattern here.
