Yes, I've actually used freeshop because it's easier to use and more informative in terms of download progress than the eShop. But if I were to open the eShop, I would be able to download my games from there.

It is very likely that some people are being banned if the setting to share information with Nintendo is enabled. If there's no record of CIA-installation in the activity log, and the user isn't doing anything else, then my assumption would be that the console wouldn't be banned.So my friend addcited to pokemon game online plays.
