Based on these results, I'm making the following predictions.

1. Some, if not many, of the unbanned people with this setting enabled are in the banwave queue.
2. Nintendo is likely using this setting as one way of banning people, but it's not the only way they're banning people, since some people with this setting turned off have still been banned.

3. We're all gonna burn and die and get banned but just not all at the same time. maybe, hopefully not.

Would like to add that i have 2 N3DS's, one had the settings on and the other has the settings off. both have NOT received a ban yet. loads friends list and online games just fine.

I allow my Mii to be shared, I have all the settings in the Friends list turned on (friends can see online status and what game I'm playing, even set homebrew as favorite sometime until I realized they can't see it without having first gotten it from a streetpass) and I'm not banned.

Not a contributing factor, someone, I think @pixelmasher said their titles being played displaying option was off and still got a ban.

I have an o3ds and an n3ds. The o3ds had the setting enabled, and the n3ds had it disabled. I've done way shadier stuff with the n3ds, but the n3ds is not banned. My o3ds is banned.

I ain't even mad.

I saw something about this ban potentially being temporary. If that is the case, I'll take it.

So did I, and I haven't been banned (or at least not yet). EUR region, 11.4 b9s luma, used freeshop extensively.

It turns on automatically when you first setup your console (at least the sending info bit, which is what is bothering), when you agree to the internet settings.

It does not automatically turn on after an update. My n3ds has always had this option off despite a number of updates.

Granted, the rep might have been misinformed. Also, this isn't a hyperban like the Sun/Moon early access bans. At least I think those were hyperbans? In any case, we can still access the eshop.
