still it would be bypassable by a luma or a9lh update or using a modded firmware
No they can completely remove the exploit.
Theoretically, it's possible that Nintendo will exploit their own arm9 kernel and remove a9lh, but it's extremely unlikely. Unless they do that, arm9loaderhax is here to stay.

What pathetic dork would seriously do this? If I had a legitimate and unique hack, and wanted to profit from it, I would demand a salary or hold it ransom for the community. $100 is just sad...
They pay based on the severity of the issue, they're not going to give $20k for some exploit that has little to no practical use, it's how basically every company with a bug bounty program works.

If it was "easy" they would have done so already.

Dear Nintendo,
1. Remove LoE from eShop
2. Profit
Sincerely, a sarcastic jackass.
They could easily stop a9lh. They can't patch it easily.
Also do you know that Nintendo are a bunch of retards? They don't patch exploits even though they know how.

Wowie, I feel like a ton of stuff is happening in the scene lately...
The Sun/Moon banwave, which resulted in amazing quantities of drama, the public LFCS_B got banned and now this?
What's next, Ninty will show up at our doorsteps to revoke all hacked 3DSses?

On a more serious note though, how exactly could Nintendo patch A9LH?
Prevent A9LHaxed 3DSses from booting?
And if so, how exactly can they tell if a console has A9LH installed?

Forgive my questions if they are stupid.

I don't want to say too much for obvious reasons, but it's quite easy to tell if A9LH is installed, but they don't even have to know whether it is to prevent a9lh booting

Woops, Read past that post. :P
I doubt they go that far.. as not all A9LH users have it for piracy only.
Homebrew games, New 3DS Clock Speed, Region Free, etc, aren't illegal, are they?
No. However they are trying to stomp out everything according to the page

I think patching a9lh is as easy as preventing the 3ds from booting if Firm0/1 are broken or corrupted. Or somehow replacing the corrupted payloads with the normal code through an update. That would revoke access to D9/H9/G9, etc.

And thus leave you with an unhacked console on stage 1.
You could still get back to hackable firmware if you made a NAND backup (Which everyone with a brain did after the plailect guide) but you would need a hardmod to do so. Hardmod itself is unpatchable without a console revision, but it can patch downgrades if you make the system need the 2.52-0 firms for booting up the console.

luma has firmprotection so it won't let a9lh be over written

You'd have to check their ToS (if anyone ever reads that), going from the hacker page it seems they deem illegal and perma-ban worthy anything that modifies the console from their "intended use", a.k.a. any feature NOT implemented by them, even if it's a no brainer that SHOULD have been done.
