No just ask it's faster, there job is to sell you stuff and they will do anything to sell you something like a New 3DS at a high price. Especially if the person that helped you get a commition.

Having a problem understanding here,
are there even any non-XL N3DS that come with anything lower than 9.5? The entry post indicates not and also everywhere I look, if I find a N3DS that has 9.2, it's XL.

I haven't been following the developments too close but from what I understand any American (regular) N3DS systems won't have an exploitable firmware. I believe EU and JP ones are still an option though.
i got refused by a dude at walmart....because? he doesn't want to do a thing and he is the only one left at the game center...so I can't complain him watching xxx during work...

The only non-XL American New 3DS is the Animal Crossing edition, and it comes with 9.8.0.
In Europe and Japan, though, there do exist non-XL New 3DS's on 9.2.0 or lower. Given that you're Algerian, I presume that you want a European one...? The Middle East is in the U.S. region for 3DS, so I honestly don't know about northern Africa.

Maybe I'll check out local stores according to serial numbers, even if it's quite unlikely to find an older one this late. There's also one on ebay that says it's 6 months old and played only 2 hours, chances are it was not updated.

I want to thank you to all those that helped and the OP. I used this on Black Friday to find 1 one out of 7 new 3ds xl's at target that was 9.0.0-20U Wooohoo. FeelsGoodMan.
I went out with this list to look for a n3ds today in Germany and the best part is in all but one story they only had empty showcase boxes on display without any serial. The last one had and an extremely patient woman who showed me every single unit they had, sadly all out if range. Lowest they had was 9.4.0. Well it was worth a shot.

Ah, they're not N3DSes then; they're O3DSes. As long as they're unopened, they'll be on an exploitable firmware.
yeah brand new from argos i have an o3ds i bought from ebay its serial number is CEM1176 it was the magic 4.5.0-20e firmware

The yokai watch bundle is the only exception they stopped being produced around 8.1 so it must be a refurb or restock/return.
