Yeah that's the problem. I'm going to ask them again but I send them an example like the picture here and they gave me that.

Did you ever find an answer to this? I have one that came with 8.1J, but I'm not sure if they made another batch or something with a higher firmware. It's risky, as I can't send it back if it's too high..

I'm still trying to settle this since I really want a Japanese New 3DS rather than an American one.

Need some suggestions about a list of excuses/reasons to be used to ask for exchange these New 3DS XL. I ran out of ideas. LOL.

Went on a shopping trip with family for Father's day to Fry's. Other than those confirmed/common >9.2 firmware serial, I could only find these 2 that were not listed yet. Try my luck. My bad luck still goes on.

This is correct, or at least was when I bought mine in january. To look at the serial number on the japanese models you have to open the box, take the N3DS out and remove the kisekae plates. I doubt they would do that to a new/unopened product since they could no longer say it was unopened, but try anyway.

If you are in Britain, why didn't you just get an EU normal sized one rather than a japanese one? If you're going to exploit it the region doesn't matter.

It seems that there are a couple serials that cover both special edition N3DSes. I believe all MM N3DSes with serials that start with a QW4XXX are from the first batch and should be on 9.2 or less as long as they haven't been used (the second batch start with QW1XXX).

Dont forget now you need either Cubic Ninja or Zelda OOT then you will be golden (try to get Cubic Ninja)
