Honestly, it's probably going to depend where it ships from (which warehouse). But I'd say anywhere from 4.1.0 to 5.4.0 is possible. More likely higher FW I guess.

Buying it used from ebay. Just ask the seller the console's FW.

You can do anything anyway now. Downgrading works even on 10.7, and you can do everything on 9.2 from CIA piracy to CFW and enabling blocked DS flashcarts.

Well, I think hacking the 3DS' DS Firmware to load ROMs from the (micro)SD would be simpler/more practical and probable.

Well, iirc the DS mode can't access the SD card when launched, and even editing TWL_FIRM can't change that :/

But what if the games are directly installed on NAND?

Well, every time someone said that something was impossible, it has been proved possible, so I guess we will be able to do this one day
And yes, TWL related games can (and need to) be installed on the NAND, but the problem is that there is only something like ~100 MB (iirc) available, so it wouldn't be possible for many games to be installed...
(games like Pokemon B2/W2 are 250 MB)

I bought that same limited edition console, not sure if the firmware depends on region but I can say the firmware was pretty low (can't remember the exact version). I used Super Smash Bros. to update to 5.3.2. Hope this helps

In the section "Getting to (and staying on) an exploitable firmware" it lists games with 5.3.2 or 5.4. there's also info on reprints of games that may have different firmware versions.

I bought the european version of that Skylanders Trap Team Bundle, i added the serial number to the wiki.

It was GEH1008 and came with 4.0.2 on the console and the disc contained 4.1.0.
