Buying it used from ebay. Just ask the seller the console's FW.
Me: "What's the firmware on the console?"
Seller: "Oh, I've just updated it to 5.5.1 so the buyer doesn't have to wait around doing that. ;)"

But what if the games are directly installed on NAND?
Or it will never be possible to launch DS games?
Well, every time someone said that something was impossible, it has been proved possible, so I guess we will be able to do this one day :p
And yes, TWL related games can (and need to) be installed on the NAND, but the problem is that there is only something like ~100 MB (iirc) available, so it wouldn't be possible for many games to be installed...
(games like Pokemon B2/W2 are 250 MB)

I bought that same limited edition console, not sure if the firmware depends on region but I can say the firmware was pretty low (can't remember the exact version). I used Super Smash Bros. to update to 5.3.2. Hope this helps

I bought the european version of that Skylanders Trap Team Bundle, i added the serial number to the wiki.

It was GEH1008 and came with 4.0.2 on the console and the disc contained 4.1.0.
