Why even it state in ToS that "You may not publish, copy, modify, reverse engineer, lease, rent, decompile, or disassemble any portion of the Software, or bypass, modify, defeat, tamper with, or circumvent any of the functions or protections of your Nintendo 3DS, unless otherwise permitted by law." still not prove that "modified 3DS Software is illegitimate" is true then? That what I want to know. I stop arguing since look like I can't change your mind though.
Like I said to the other user. I will agree with you and say I'm wrong just as soon as I see on the ToS or any Nintendo documentation saying modified units are illegitimate.

I paid full MSRP for this handheld and it works fully as intended. I can still play 3DS games, play online and connect on the eShop and make purchases. Thats as legit as it gets. This isnt some Chinese knockoff unit.

You 're pointing to the "console", not the "action".
Yeah, if that console is produce by Nintendo. It's always "Legimate 3DS Console hardware" no matter what.
But, after you installing A9LH + CFW which consider "illegitimate action", your 3DS will become "Legimate 3DS Console hardware with illegitimate software".
Which, breaking Nintendo ToS. Is this clear enough?
