mine (small black model) came with 9.9

I got a EUR brand new blue XL unit yesterday, it came with 9.9
I'd say we are pretty good, won't see factory 11.0 for a while, and even then you can do the hardmod Downgrade

Depends on the stock and which n3ds XL you want. My n3ds XL fire emblem fates edition came with 11.0 and it was a bitch since I had to hardmod to 9.2. Your best bet with a low firmware version is getting one of the first models the black or the blue.
