I've noticed people uploading the nintendo online subscription games like the nes/snes ones and tetris 99. don't those games have to phone home every week or has that been patched out? or, is there another way around that problem? the 360 can fake a live connection, so is that what's happening with those games?

Now that you mention it...I guess if installed regularly through the eshop, yeah, they might demand to call a specific phone number and whatnot.
But I have the NES/SNES app installed through Gold leaf and they work flawlessly.
Do as @hippy dave above said and you should be fine.
 
Tetris 99's multiplayer obviously requires Nintendo Online service to connect to. However the paid DLC includes single player modes, which can be played regardless of internet connection, so they have to let you launch the base game with or without NSO.
