MPAA Admits Piracy Is Not "Theft"

This definition defines the very reason I don'tt want N to go totally download. It keeps them from giving us something, that we would have recieved before, the cartridge. We / well I bought cartridge AND game , not just the game. I want them both or drop the price drastically.. Basically Nintendo will be ripping US off by selling the games at the old price but by DEPRIVING us of the cartidge. THAT's Theft. That road travels both driections Nintendo. If you wanted thier definitions before you must stand by them now too N.

Since when did Nintendo deprive you of anything? They're enabling digital distribution as an OPTION. AN OPTION. want me to spell that out for you? You can still buy the cartridge off of shops if you prefer retail, but you can also DOWNLOAD it, but only if you want to. They don't force it to you.

Show me ANY store where I can buy a 3DS cart of every single eShop game, including the VC titles. There is NO OPTION when it comes to digital distribution. I can not go out and buy a 3DS cart containing Yoshis's Island or Mario vs Donkeykong...

Dafuq, it's NOT EVEN IMPLEMENTED YET. and why dafuq would you ask me about 3DS carts of eShop games? are you mad? why would you insist on looking for something that DOES NOT EXIST? and you even got it backwards... Nintendo NEVER announced going from Digital to Retail, but the other way around. THAT's the OPTION i was talking about. Instead of retail games being strictly tied to physical carts, now you can also buy em and download em online.

LOL, you lookin for holes, man. Ever since eShop has been announced, it was first and foremost for digital distribution ONLY. Of course you're not gonna find retail cartridges for almost all of the games there. The option I was referring to was the other one, having retail games be available for download online. Again, you're looking for something that flat out does not exist. Lol, using non-existent things as an example... please, no more.

'Theft' can be a misdemeanor or felony

'Infringement' a crime less serious than a felony - so a misdemeanor

So if piracy is not theft and is in fact a misdemeanor then if I understand correctly then any prosecution would have to be on the basis of a misdemeanor which still amounts to a jail term of a year or a fine or both.

(At least in the UK).

So nothing has changed. It's still a crime lol

If you have no valid way to backup any games software that you download (which with Nintendo you don't), then you never actually own it. They can rip the carpet out from under you at any time the want. That is the point.

It's not exactly Nintendo's fault if devs prefer to publish and distribute their games ONLINE ONLY. Take your beef with them. Or with the tons of other companies that do digital distribution. If you're really that worried, then pray somebody cracks the living shit out of eShop/3DSware so that people can "backup" games as much as they want... or is that really what you've been trying to say all this time? Scratch that, might be a bit outta line.

Just remember, you're buying only digital copies of games. You own your specific copy, but that's that. Hell, we're lucky you can still download it afterwards if you decide to delete it.

As for that whole aspect of backing up games for retro gaming, I wouldn't be too worried about it. I'm not personally inclined, nor do I feel a burning need, to save most of what's available digitally. There'll be better stuff to come anyways. As long as the video game market don't crash, that is.
