I'd say it's illegal in the same way a store selling them would be viewed however the volume of consoles a small store would sell compared to you selling your old console are light years apart from being caught/prosecuted on it.
I don't know if your local law enforcement would monitor the likes of gumtree ads for a hooky console but I'd predict probably not all. Again tho, multiple sellers? Probably more so.
